License Site Remediation Professionals

On May 7, 2009, New Jersey Governor Jon Corzine signed the Site Remediation Reform Act (S.1897/A.2962), which includes the new Licensed Site Remediation Professional (“LSRP”) program. The new legislation impacts the way transactions and redevelopment projects are handled in New Jersey. The LSRP program licenses environmental consultants and contractors certified by the New Jersey Department of Environmental Protection (“NJDEP”) and overseen by a licensing board. Hudson’s LSRP can expedite the cleanup process since LSRPs can issue Response Action Outcome letters, which take the place of No Further Action letters, at the conclusion of investigations and cleanups. All new projects subject to New Jersey’s Site Remediation Program must be overseen by LSRPs rather than the NJDEP, unless they fall into specific exemptions. When the act becomes fully effective in 2012, all remediating parties must use the services of a LSRP and must proceed with the cleanup of their site without prior NJDEP approval.
