Phase I and II Services

A Phase I Environmental Site Assessment is an environmental study of a property that is designed to identify “recognized environmental conditions” with respect to hazardous substances and petroleum products. The identified conditions may or may not warrant further assessment. The further assessment is known as a Phase II Environmental Site Assessment.

“Recognized environmental conditions” is defined by the American Society for Testing and Materials (or “ASTM”) as the presence or likely presence of any hazardous substance or petroleum products on a property under conditions that indicate an existing release, a past release, or a material threat of a release into structures on the property or into the ground, groundwater, or surface water of the property, even under conditions that are in compliance with laws. The term is not intended to include de minimis conditions that generally do not present a material risk of harm to public health or the environment and that generally would not be the subject of an enforcement action if brought to the attention of appropriate governmental agencies.

The ASTM Phase I assessment does not include the collection of any samples, nor does it address various environmental issues including asbestos-containing materials, radon, lead-based paint, lead in drinking water, wetlands, regulatory compliance, cultural and historic resources, industrial hygiene, health and safety, ecological resources, endangered species, indoor air quality, high voltage power lines, and others. FAQs

Q: Who needs a Phase I Environmental Site Assessment?

A: Anyone who is purchasing or leasing a commercial or industrial property needs a Phase I Environmental Site Assessment. Sometimes the assessment is performed for a residential, agricultural, or undeveloped property. Sometimes the seller or lessor wishes to complete a Phase I in anticipation of a sale or lease of the property.

Q: When should a Phase I Environmental Site Assessment be performed?

A: It should be performed as early as possible in the property transaction process.

Q: Are there different types of Phase I Environmental Site Assessments?

A: Yes, there are. The most common type of Phase I follows ASTM practice E1527. Sometimes, a Phase I Transaction Screen (ASTM practice E1528), which involves less study and costs less than practice E1527, is desired. Additional services to address the non-scope considerations (see above) can be added to either of the practices.

Q: What happens after the Phase I is complete?

A: The Phase I may identify recognized environmental conditions which may warrant further assessment. The further assessment is known as a Phase II Environmental Site Assessment. It is up to the purchaser (and sometimes the lender) as to which conditions will be tested and is based on the level of “risk tolerance”.
