Environmental Cost Recovery

Hazardous Discharge Site Remediation Fund ("HDSRF") This fund is maintained by the New Jersey Environmental Claims Administration ("ECA"). If you acquired a property before December 31, 1983, and if you have not used the hazardous substance found at the property, you may be eligible for financial assistance (a low interest loan) or a grant.

Spill Fund - The ECA will consider Damage Claims made by individuals, businesses, and government units that have suffered direct or indirect damages from the discharge of petroleum products or other hazardous substances. These damages include, but are not limited to, the cost of restoring, repairing or replacing real estate or personal property, and/or loss of income or tax revenue.

Insurance Coverage - Many insurance policies written in the 1980s and earlier did not have pollution exclusion provisions. Maintain copies of the old policies and if there are no pollution exclusion provisions, you may be able to initiate legal action against the insurance company for coverage of environmental damages.

Litigation against the Responsible Party - If someone has contaminated your property, you will need the support provided by Hudson's clear, concise, and complete environmental investigation and reporting services and expert testimony services.
